California is getting ready for a fight. For as [NPR](https://www.npr.org/2019/09/18/761815991/white-house-to-revoke-waiver-allowing-california-to-set-its-own-emissions-standa)
reports:

#### Trump Vs California

 1. President [Trump](https://greenlivingguy.com/2019/11/gms-siding-with-trump-administration-reveals-a-lack-of-commitment-to-clean-efficient-vehicles/)
said his administration is revoking a waiver that allowed California to set its
own standards for automobile emissions — a move that could derail a years-long
push to produce more fuel efficient cars.
 2. In a series of tweets, Trump said the action will result in vehicles that are safer
and cheaper, and that “there will be very little difference in emissions between
the California standard and the new U.S. standard.”
 3.  Environmental Protection Agency Administrator Andrew Wheeler telegraphed the planned
announcement on Tuesday. Speaking to the National Automobile Dealers Association,
he said, “In the very near future, the Trump administration will begin taking the
steps necessary to establish one set of national fuel-economy standards.”
 4. The not just [Obama-era waiver](https://www.federalregister.gov/documents/2013/01/09/2013-00181/california-state-motor-vehicle-pollution-control-standards-notice-of-decision-granting-a-waiver-of)
but it started with the first President Bush and was taken away from President
W Bush. It was then re-issued by the [EPA](https://greenlivingguy.com/2018/04/conservative-group-ceis-myron-ebell-andrew-wheeler-well-suited-deputy-administrator-epa-job/)
to the California Air Resources Board in 2013. Thereby allowing the state to set
stricter air quality standards than those imposed at the federal level. States
    rights!

#### Let’s Talk Clean Air Act!

**As [Car and Driver](https://www.caranddriver.com/news/a29092318/trump-california-emissions-standards/)
reports:**

Since the 1970 [Clean Air Act](https://greenlivingguy.com/2025/12/big-win-for-detroit-via-sierra-club/),
the federal government has let California set stricter emission standards. This
was to be joined by other states that wish to follow the same regulations.

California’s waiver has never been permanently revoked by any administration. However
the law allows the federal government to do so. President Trump claims automakers
would be “out of [business](https://greenlivingguy.com/2021/03/going-the-extra-mile-how-caring-can-help-make-your-business-friendlier-to-the-environment/)”
without such an intervention. I think he’s wrong. I think that the consumer public
is more aware of electric cars than ever before.

Consequently this move the Trump Administration comes none other than after the
Department of Justice launched an investigation.

This is only because of an antitrust investigation into a July deal. Trump hates
not being part of a deal. This one is between California and four automakers. They
are Ford, Volkswagen, Honda and BMW. Because that is seen as a broader effort by
the White House to roll back efforts to combat climate change.

#### The Statistics are For Electric Car

In fact, 60 percent of people are going to buy an [electric car in the next](https://greenlivingguy.com/2007/03/electric-cars-the-next-big-thing/)
3-5 years. So where are we going but backwards economically and strategically.

Furthermore, Car and Driver reports automakers are less bullish than President Trump
and his administration. In fact, [Ford, Honda, Volkswagen, and BMW struck a deal with California. All to achieve a 50-mpg standard by the 2026 model year. That’s especially in spite of federal rollbacks. Now they’ll have to decide whether to push ahead with that pledge.](https://www.caranddriver.com/ford)

#### Rivian Another Game Charger

In fact today, Amazon placed a purchase order with Rivian for 100,000 trucks. The
Rivian “skateboard” is ALSO being added to the Ford F-150 and Mustang electrics.
They are faster and stronger than any gas car on the market.

They are typically better and safer than most gas cars. So this attack on these
cars is something President Trump will hurt American car companies. The free market
yield curve for sales on Tesla motors is just like the Model T for Ford. He can’t
stop that. He’s trying but people are not having it. Meaning the private sector
and the American if not global economy.

#### Compare the MPG

As Car and Driver added EPA in a proposed ruling jointly issued by the National
Highway Traffic Safety Administration (NHTSA). IT has never so explicitly favored
economics to justify a new standard. Moreover it’s totally against California and
State’s rights as in the Constitution!

The 978-page proposal states that the EPA wants to freeze Corporate Average Fuel
Economy (CAFE) targets (which are set by NHTSA) and greenhouse-gas emissions (which
are set by the EPA) at the 2020-model-year level.

If approved, the EPA would retain the industry-wide average of for the nation’s
fleet of passenger cars and light trucks. All for model years 2021 through 2026.
As I know. This is so much a darn joke!

Compare that to the Obama-era rule that mandated a rise to _46.7_ mpg by 2025. The
widely reported 54.5-mpg figure was from 2012.

However that was when the [EPA](https://greenlivingguy.com/2014/04/epa-releases-top-25-list-of-cities-with-most-energy-star-buildings/)
first approved the current plan. All for requirements through the 2025 model year.
However it only refers to passenger cars.

In conclusion, the new car is now average is _43.7_ mpg. (All figures are based
on [older CAFE calculations](https://www.caranddriver.com/features/a15146459/csaba-csere-after-30-years-the-epa-finally-comes-up-with-realistic-fuel-economy-estimates-column/)
and not current “real world” EPA estimates on new-car window stickers.)

So, [they finally went and did it](https://u7061146.ct.sendgrid.net/ls/click?upn=4tNED-2FM8iDZJQyQ53jATUfv84-2Ff5Yo9Fs-2FA-2FL-2ByWKLnFpiiTV8KcNf2HrRaWx-2Fso98XZZwu-2B4cX2eFikDCx2ew71mPN8APNy-2BnU6rUFW5XDGNySX0MtCtW63YK56Ufzuwr6TNj3-2Fn8wxtNOGSUkNSGMyM5V3o8fuESKE24r1Qxo-3DitVK_INCA-2FPyIhC63I1FHQ-2FtwXKsMamN5mBOz6hLuWKtOi7ltuBM5st1wBrm-2FpEURVhKNBxVIxhbJz9Mw1-2FOJMibrGViXcXOGxVwjnS0TAMb59XnB9TrF6MgV95RdsYlOQX36yU7RDts46Fobbl62CMLWKZnUStD1-2FSHhTiXRh8EXBjgKZSehCxQbhAncqM0kb27VED4OCcTp9t52b67bnBVQBOzpeWnR5fjpdRopQchX-2BYoO37OwFxMex81WGVYjXG-2Bop2jJH99gRT7QkeT34s-2FOWAvemJles-2Fy5nAdxzLqs1Qj3TQixw79YkORHnnBrS-2BaNhI2ALlM4u4L85-2Fzvr-2F8vj80SlOftCs6dXNM8868jZxs-3D)—
President Trump and his administration just finalized a rule to undo requirements
on manufacturers to improve fuel economy and reduce greenhouse gas emissions from
new passenger cars and trucks. Even with the economy at the brink of a recession,
they went forward with a policy they know is bad for consumers. For their own analysis
shows that American drivers are going to spend hundreds of dollars more in fuel
as a result of this stupid policy. However they went ahead and did it anyway.

### The rule, by the numbers

The administration recognizes this is a bad deal for the country. I mean even their
own cooked books couldn’t make this look like a good idea:

 * American drivers will burn an additional **2 billion** barrels of oil. Thereby
   resulting in 900 million metric tons of additional global warming emissions;
 * Vehicle prices could be reduced by $1,000, but consumers would pay more than **
   $1,400 more in fuel**, a net loss and obviously a terrible deal;
 * Accounting for miles traveled, the rule results in more premature deaths from
air pollution (up to 1600), than offset by the agencies’ (optimistic) estimate
   of less than 800 avoided traffic fatalities;
 * The rule cuts automotive revenue by $50 billion dollars, resulting in **job losses**
in the auto sector of 10,000-20,000 in 2030, a number which excludes the [even worse macroeconomic job losses](https://blog.ucsusa.org/don-anair/auto-standards-rollback-oil-companies-win-everyone-else-loses)
   which would accrue;
 * The net benefits of the rule are actually **negative**, resulting in **$10-20
billion in net monetized harm to the country**, which is actually a **worse **
outcome than most of alternatives the agency considered!

And on top of all this, the EPA and National Highway Traffic Safety Administration(
NSHTA) found time to incorporate special corporate giveaways to the fossil fuel
industry, [the only industry slated to benefit from this rule](https://blog.ucsusa.org/don-anair/auto-standards-rollback-oil-companies-win-everyone-else-loses)
in the first place.

#### The final rule is NOT necessarily better than the proposal

There will likely be a [lot of reporting that says](https://greenlivingguy.com/2010/06/a-lot-to-say-celebrities-wearing/)
that this final rule is better for the environment than the proposal, but this is
wrong. **On paper,** the Trump administration has replaced its proposal to halt
required progress entirely after 2020 with a rule that requires 1.5 percent improvement
per year, a rate which is of course [lower than the automakers have averaged now for more than a decade](https://blog.ucsusa.org/dave-cooke/most-fuel-efficient-cars-a-win-for-consumers-pockets-the-economy-and-climate-but-whats-next).
But paper targets don’t matter—what matters is what happens in the real world. And
all this rule is doing is maintaining the status quo.

While ostensibly increasing the requirements of the rule, the Trump administration
has also increased flexibilities and credits granted to automakers compared to the
proposal, credits which the industry requested and which we’ve shown [could be as bad as the rollback](https://blog.ucsusa.org/dave-cooke/congress-is-pushing-back-on-the-trump-fuel-economy-rollback-why-arent-auto-companies).

Incredibly, they’ve even granted credits that no automaker asked for, for natural
gas vehicles that no one currently sells (of course, that was a handout to the oil
industry, just like the rest of this rule). While they didn’t grant all automaker
requests, they did extend through 2026 the decision to ignore emissions from the
electricity powering EVs and increased the number of technologies eligible for credits
not captured by standards test procedures (so-called “off-cycle credits”) while
simultaneously reducing the public scrutiny on those emissions, even though recent
data on some of these credits [calls into question their value](https://theicct.org/publications/US-2025-off-cycle).

Awarding automakers these flexibilities and loopholes makes the miniscule change
in stringency completely toothless. Consumers will continue to be railroaded by
this change in policy.

#### The economy is in a tenuous position—this rule will make it worse

Right now, the economic outlook is uncertain—we are [shedding jobs by the millions](https://www.nytimes.com/interactive/2020/03/26/upshot/coronavirus-millions-unemployment-claims.html),
and even after we come out of this pandemic, we will [likely be dealing with a recession](https://www.foreignaffairs.com/articles/2020-03-17/coming-coronavirus-recession).
The administration’s policy just compounds that economic pain for consumers by ensuring
they pay more at the pump. This is exactly the wrong policy at the worst time—what
we need to be doing is helping consumers pay less in fuel so they can put those
saving back to work in our local economies.

Consumers will pay thousands  more for fuel as a result of this rule, which hurts
the economy and [negatively impacts job growth](https://blog.ucsusa.org/don-anair/auto-standards-rollback-oil-companies-win-everyone-else-loses).
The only people that benefit from the administration’s finalized rule are the oil
companies.

#### The SAFE rule is unsafe

One of the biggest, dumbest points made in the original proposal was that this rule
would save lives. But the administration admits now that such claims were total
nonsense. Even by their own fuzzy math, the “tens of thousands of lives saved” from
the proposal have been reduced to just a few hundred, and now that they’ve finally
bothered to calculate the adverse health impacts, they’ve found that up to 1600
people would die prematurely thanks to the additional air pollution from this rule(
a number that is [likely a significant underestimate](http://blogs.edf.org/climate411/files/2019/05/FINALGHGREPORT.pdf)).

We are in the middle of a public health crisis that’s devastating our economy, and
the administration is finalizing a rule that will undermine both public health and
the economy. If that isn’t some of the most backwards nonsense ever, I don’t know
what is.

#### Fighting it out in the courts

As with [so many of the administration’s wrongheaded rollbacks](https://www.cnbc.com/2019/01/24/trump-has-lost-more-than-90-percent-of-deregulation-court-battles.html),
this one will end up in the courts. There continue to be a mountain of errors in
the policy and a number of corners cut to [avoid public scrutiny](https://yosemite.epa.gov/sab/sabproduct.nsf/LookupWebProjectsCurrentBOARD/1FACEE5C03725F268525851F006319BB/$File/EPA-SAB-20-003+.pdf)
and [sideline the administration’s own experts](https://www.theatlantic.com/science/archive/2020/02/an-inside-account-of-trumps-fuel-economy-debacle/606346/).

This policy is bad for consumers, bad for public health, and bad for the environment.
And we will continue to fight it in the courts because this country deserves better.
